In LeAnn Rimes Twitter lawsuit against teacher Kim Smiley and her daughter Lexi delayed as Smiley’s attorney drops them as clients. He has petitioned the court to release him from the case.
Kenneth Freundlich was Kim Smiley’s attorney until he tried to get her to sign the form allowing him to withdraw from being her attorney. However, Smiley decided she wasn’t letting him off that easy and refused to sign the form.
Once Kim Smiley refused to sign the paper, Freundlich filed a motion in the Los Angeles Superior Court and the judge in the case finally granted his request to no longer represent Smiley.
A source stated that, “That’s highly unusual. Usually a lawyer and client agree to separate and the lawyer doesn’t have to ask the court to let him out.” It seems that Smiley and Freundlich weren’t seeing eye to eye any longer and finding a new attorney was just a matter of when not if.
In the court papers Freundlich filed to be relieved as Smiley’s attorney he stated that, “there were irreconcilable differences concerning this case and as a result there has been a complete breakdown in the attorney-client relationship. My firm cannot represent these clients in any manner in this case.”
LeAnn Rimes is suing Kim Smiley for invasion of privacy. According to Rimes, Smiley illegally recorded a telephone conversation that took place with Rimes called her.
Both sides of the matter are claiming foul with the people close to Rimes claiming that she is a victim of social media bullying.
People close to Kim Smiley believe that Rimes was behaving improperly on Twitter and at the very least had her friends antagonize those who aren’t a fan of Rimes. They also believe that her lawsuit is a bullying tactic against a woman who doesn’t have the money to fight her.
Kim Smiley replaced Freundlich with Stephen White. They are scheduled to have a case management conference on April 9.
